Elon Musk Withdraws Lawsuit Against OpenAI; What We Know

Elon Musk, a billionaire businessman, has moved to dismiss his lawsuit against OpenAI, the company behind ChatGPT, and its CEO, Sam Altman. In the lawsuit, Musk claimed that Altman had abandoned the company’s original goal of using artificial intelligence to advance humanity rather than making money.

According to a filing in San Francisco Superior Court, Musk’s legal team asked that the February lawsuit be dismissed from California state court without explanation.

On Wednesday, a Superior Court judge there was set to consider OpenAI’s motion to dismiss the lawsuit. Musk was able to resubmit his case at a later date because it was dismissed without prejudice.

Musk’s long-simmering criticism of OpenAI, a company he co-founded and which has since received billions of dollars in funding from Microsoft, came to a head with the lawsuit.

Musk established his own artificial intelligence startup, xAI, in July of last year. In May, the company raised $6 billion in series B funding, valuing the business at $24 billion after taking out loans. According to the lawsuit, Greg Brockman, co-founder of OpenAI, and Altman approached Musk to create a nonprofit, open-source business, but the 2015 startup is now primarily focused on turning a profit.

According to the lawsuit, OpenAI “set the founding agreement aflame” last year when it unveiled GPT-4, its most potent language model.

In the lawsuit, Musk requested that a judge order OpenAI to stop using its assets — including GPT-4 — for the financial gain of Microsoft and other parties, as well as to make its technology and research publicly available.

In a court filing, OpenAI contended that the lawsuit was founded on illogical assertions and that Musk was manipulating it to further his personal AI goals.

“Seeing the remarkable technological advances OpenAI has achieved, Musk now wants that success for himself,” OpenAI’s attorneys said. In an April filing, Musk claimed that OpenAI was attempting to “advance arguments that are based on disputed facts” that were outside the purview of the legal action.
